TERMS OF USE

  • By using the Social Pinpoint Mapping Tool (“Mapping Tool”) you are deemed to have read and agree to comply with these Terms of Use.

PURPOSE OF MAPPING TOOL

  • Waipā District Council (“we” or “our”) will be engaging with the community to create Ahu Ake - Waipā Community Spatial Plan. This will become a blueprint for the future of our district.
  • The Mapping Tool allows you to provide your feedback on this project and see and comment on the feedback of others. This will provide an online discussion in a similar way to what would be achieved through our face-to-face community engagement sessions.  Our consultant Beca will be helping us review, manage and moderate the Mapping Tool on our behalf. 

NO PERSONAL INFORMATION 

The Mapping Tool is a public online space. All content you post is viewable by the public.  

  • We do not request nor collect any personal information about you on this site. 
  • Your posts will be anonymous. 
  • You must not include any information that identifies you or others in your posts. 
  • Posts that contain personal information about identifiable individuals will be considered a breach of the user restrictions and may be removed from public view and permanently deleted. 

USER RESTRICTIONS

In using the Mapping Tool, you agree to comply with the following user restrictions:

  • You must not publish or post any information that identifies you or other people, including Waipā District Council staff or the staff of Beca and our other contractors or consultants.
  • You must not make defamatory statements about another person.
  • You must not post anything that could be considered intolerant of a person's race, culture, appearance, gender, sexual preference, disability, religion or age.
  • You must not post offensive or threatening language or remarks, including swear words or words in breach of legislation.
  • You must not make posts that personally insult or harass other participants.
  • You must not make posts that promote self-harm, suicide, violence or criminal activity of any kind.
  • The use of emojis or images to convey inappropriate meaning consistent with the rules outlined above will also be moderated.
  • You must not impersonate individuals, groups, or organisations in a manner that is intended to or does mislead, confuse or deceive others.
  • You must not attempt to advertise, sell or facilitate the sale of any goods or services (whether they are legal or illegal goods or services, and whether they are for sale by you or a third-party).
  • You must not post anything that is in furtherance of illegal activities, or that promotes or incites illegal activities.
  • You must not breach any other person’s intellectual property rights (including copyright and trademark).
  • You must not post sensitive media, including media that depicts gore, graphic violence, adult content, nudity, sexual violence and/or assault.
  • You must not threaten to expose a person’s personal information or incentive others to do so.
  • You must not undermine the security or integrity of our computing systems or networks.
  • You must not use the Mapping Tool in any way that might impair functionality or interfere with other people’s use.
  • You must not introduce or upload anything that infringes any intellectual property or other rights of any person; violates any applicable law or is illegal; or violates any third-party’s right, including right to privacy.
  • You must not introduce or upload anything that contains software viruses, trojan horses, worms, time bombs, cancelbots or any other computer code, files or programs designed to or that may interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment.
  • You must not interfere with or disrupt our website or servers or networks connected to our website, or disobey any requirements, procedures, policies or regulations of networks connected to our website.
  • You must not modify, copy, adapt, reproduce, disassemble, decompile, reverse engineer, or extract the source code of any part of the Mapping Tool 

CONSEQUENCES OF BREACH

Without limiting any of our rights of remedy, if we consider that there has been a breach of the user restrictions, we may:

  • Remove any post - any comment that, in our view, breaches the user restrictions may be removed.
  • Permanently Block – we may permanently block a user who continues to violate the user restrictions. Such use may be reinstated in our absolute discretion following a period of suspension.
  • Automatically Block - a participant who posts or links to inappropriate, offensive or illegal material will be immediately blocked from the site.

COMPLAINTS

If you become aware that any other user has breached these Terms of Use you must promptly notify us. Send your notification by email to: ahuake@waipadc.govt.nz 

Your notification should specify the following:

  • Your contact details.
  • The full details of the material.
  • The exact and full url where you found the material.
  • If the request relates to copyright, provide proof that you are the rights holder and a statement that, you are the rights holder or are an authorised representative. 
  • The reason for your request. 

FURTHER TERMS

  • You warrant that you have all rights, power and authority necessary to submit any content into the Mapping Tool.
  • While you retain any ownership rights in any content you submit, you grant us a worldwide, royalty-free, perpetual, irrevocable, non-exclusive, transferable and sublicensable licence to use, copy, modify, adapt, prepare derivative works of, distribute, store, perform and display your content.
  • While we are providing the Mapping Tool to use in good-faith, the Mapping Tool is provided to you ‘as-is’ without representations, warranties or conditions of any kind. We make no guarantee as to the availability, reliability. title or fitness for purpose of the Mapping Tool. We take no responsibility for the posts of any of the users. Our liability to you whether in tort (including negligence), contract, breach of statutory duty, equity or otherwise, arising in connection with the Mapping Tool and these Terms of Use is excluded to the fullest extent permitted by law.
  • These Terms of Use may be modified by us at any time.

Ahu Ake - Waipā Community Spatial Plan

We’re in the early stages of developing Ahu Ake – Waipā Community Spatial Plan which will determine what our district, towns and villages will look like in 2050. 

It is the most important plan we will create for our district, and it will set the direction for everything we do.  

But the plan needs you!

Over the past year, we’ve created the bones of a draft plan by working alongside our Mana Whenua partners, organisations across the district, and applying what we already know is important to our communities from what you’ve told us before.

Now we would like to get your thoughts on what we’ve put together.

There are six interactive maps (on the left-hand side bar) which we would like you to take a look at. These highlight key focus areas in the plan and how they relate to the district as a whole and to each of our towns and villages.

You can tell us what you think about these key focus areas by:

  • Commenting on the project icons on the interactive maps
  • Sharing other ideas you may have by dragging and dropping a marker (sitting at the top of the page) onto the map
  • Filling out the survey at the bottom of each topic page 

You can also view, comment and like or dislike other comments, ideas and suggestions that have been left on the map.

Note: Your comments will be displayed publicly so others can join in the conversation. 

Your feedback will be used to further develop, refine and confirm our draft spatial plan. From there, we’ll share the plan with you for further feedback before it is finalised.
